Hiring on Abekus — Fair, Accountable, and Privacy-First

These Recruiter Terms govern how employers, recruiters, and hiring organisations use Abekus — including the use of applicant data, permitted and prohibited activities, anti-discrimination obligations, data retention after hiring, and the licence for Abekus to identify you as a platform user in marketing communications.

    1. Who This Applies To

    • These Recruiter Terms govern the use of Abekus by anyone acting as an employer, recruiter, hiring manager, placement officer, or agent of an organisation (together, “Employer”) — that is, any user who accesses candidate profiles, posts jobs, or manages an organisation on the platform.

    • These Recruiter Terms are in addition to Abekus's general Terms & Conditions and Privacy Policy. Where the two conflict in the context of employer use, these Recruiter Terms take precedence.

    • The person accepting these Terms warrants that they are authorised to bind the organisation on whose behalf they are using Abekus.

    2. Permitted Use of Applicant Data

    • Applicant information (including resumes, parsed profile data, skill scores, contact details, and Fair Play Score outputs) is made available to Employers solely for the purpose of evaluating candidates for roles posted by that Employer or for discussing adjacent opportunities the Employer genuinely intends to offer.

    • Employers may contact applicants through Abekus messaging or through the contact details shared by the applicant, only for the hiring purposes described above.

    • Employers must treat applicant data as confidential and limit access to personnel involved in hiring decisions.

    3. Prohibited Use

    • Employers must not — whether directly, through a third party, or through automated means:

    • a) Resell, sublicense, or redistribute applicant data, including parsed resume content, skill data, contact information, or Fair Play Score outputs.

    • b) Use applicant data to train, fine-tune, or evaluate machine-learning models, language models, embeddings, or any derived analytics product offered outside the Employer's own internal hiring workflow.

    • c) Perform bulk export, scraping, or harvesting of applicant profiles, including via headless browsers, screen-scraping tools, or unauthorised API usage.

    • d) Contact applicants for purposes that are not bona fide hiring (including marketing of unrelated products, surveys, recruiter marketplaces, or list building).

    • e) Misrepresent the role, compensation, location, or the identity of the hiring organisation in any Employer-posted content.

    • f) Circumvent platform controls, including profile visibility settings, rate limits, paid-tier boundaries, or account verification requirements.

    4. Confidentiality & Data Security

    • Employers shall take reasonable steps to protect applicant data from unauthorised access, disclosure, alteration, or loss — including access controls on internal systems, secure handling of exported documents (such as downloaded resumes), and prompt deletion when no longer needed.

    • If an Employer becomes aware of any unauthorised access to or disclosure of applicant data obtained from Abekus, the Employer must notify Abekus at support@abekus.ai without undue delay, and cooperate with any investigation and remediation.

    5. Anti-Discrimination & Human Decision-Making

    • Abekus surfaces candidates using automated signals — including extracted skills, skill similarity scores, profile match scores, and the Fair Play Score for assessment integrity. These are decision-support inputs, not hiring decisions.

    • The Employer is solely responsible for the hiring decision and for ensuring that its use of Abekus signals complies with applicable anti-discrimination and equal-opportunity laws (including, where applicable in India, the Rights of Persons with Disabilities Act, 2016, and any comparable laws of other jurisdictions from which the Employer operates or hires).

    • Employers shall not use Abekus signals as a sole or determinative basis for rejecting an applicant, and must retain a meaningful human review of every hiring decision.

    6. Data Retention and Deletion After Hiring

    • Employer may retain applicant data obtained from Abekus only for as long as reasonably required for the specific hiring process and for any directly-related legal or record-keeping obligations.

    • Once the hiring process for the relevant role is closed, the Employer shall delete or anonymise applicant data when it is no longer reasonably necessary for the hiring process or for any directly-related legal, audit, or record-keeping obligations the Employer is subject to.

    • Applicant data obtained from Abekus should not be merged into general CRM, marketing, or recruiter-contact databases.

    7. Licence to Use Employer Name and Logo

    • Employer grants Abekus a non-exclusive, royalty-free, revocable licence to use the Employer's organisation name, logo, and brand marks in user-facing communications — including emails, landing pages, in-product surfaces, and marketing materials — for the limited purpose of identifying the Employer as an active user of the Abekus platform.

    • This licence is factual and non-endorsing. Abekus shall not use the Employer's marks in a way that implies sponsorship, endorsement, or affiliation beyond the factual statement that the Employer uses the platform.

    • The Employer may revoke this licence at any time by written notice to support@abekus.ai. Abekus will remove the Employer's marks from new user-facing communications within 14 days of receiving revocation, and will use reasonable efforts to phase them out of already-distributed or cached content (recognising that some older emails, indexed pages, and third-party caches are outside Abekus's practical control).

    8. Employer Representations

    • The Employer warrants that:

    • a) The information provided about the organisation, its roles, compensation, and hiring process is accurate and not misleading.

    • b) The Employer has the legal right to operate as an employer or recruiter and has not been prohibited from doing so by any court, regulator, or prior adverse finding of Abekus.

    • c) The Employer will comply with all applicable labour laws, data-protection laws, and consumer-protection laws in the jurisdictions where it operates or hires.

    9. Payment & Subscription (If Applicable)

    • Where the Employer purchases a paid plan, subscription, or credits/gems usable for recruiter features, charges and refund terms are governed by the pricing page, the order confirmation, and Abekus's Cancellation & Refund Policy.

    • Payment processing is handled by third-party payment providers. Abekus does not store full payment card details.

    • Abekus may suspend access to paid features for non-payment, in which case applicant data already accessed must continue to be handled in accordance with these Recruiter Terms, including Sections 4 (Confidentiality) and 6 (Retention).

    10. Indemnity

    • To the fullest extent permitted by applicable law, the Employer shall indemnify and hold harmless Abekus (Wikasta Business and Technical Solutions Pvt. Ltd.) and its directors, officers, employees, and agents against any claims, losses, damages, fines, or expenses (including reasonable legal fees) arising from:

    • a) The Employer's misuse of applicant data in violation of these Recruiter Terms or applicable law.

    • b) The Employer's hiring decisions (including any claim that a decision was discriminatory or otherwise unlawful).

    • c) Inaccurate or misleading information provided by the Employer on the platform (including job posts and organisation details).

    11. Suspension and Termination

    • Abekus may suspend or terminate an Employer's access to the platform if the Employer breaches these Recruiter Terms, violates applicable law, engages in abusive conduct toward applicants, or poses a risk to the integrity of the platform.

    • Material breaches (including unauthorised resale of applicant data, scraping, or discriminatory conduct) may be actioned without prior notice.

    • Upon termination, the Employer must promptly delete applicant data obtained from Abekus in accordance with Section 6, other than minimal records required by law.

    12. Changes to These Terms

    • Abekus may update these Recruiter Terms from time to time. Material changes will be flagged in-product and via email to the primary contact on the Employer's account, and continued use of Employer features after the effective date constitutes acceptance.

    • If the Employer does not agree with a change, the Employer may stop using Employer features and contact support@abekus.ai for account closure and data handling.

    13. Governing Law, Disputes, and Grievance

    • These Recruiter Terms are governed by the laws of India. Wikasta Business and Technical Solutions Pvt. Ltd. has its registered office at C-6, Jawahar Nagar, Bharatpur, Rajasthan 321001, India, and carries on business at Jaipur, Rajasthan. The courts at Jaipur, Rajasthan, India shall have exclusive jurisdiction over any disputes arising from these Terms, without prejudice to Abekus's right to seek interim relief in any competent jurisdiction.

    • Before initiating formal proceedings, the parties shall attempt to resolve disputes in good faith by writing to support@abekus.ai (marked “Recruiter Dispute”).

    • For grievances relating to personal data processing or platform content under the Digital Personal Data Protection Act, 2023, and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, please refer to the Grievance Officer listed in our Privacy Policy.
